While this definition may be broad, there are specific federal criminal statutes that are implicated in this form of gambling. In particular, Section 5362 of the U.S. Code defines unlawful Internet gambling as: “The offering or facilitating of a bet, or the receiving or transferring of bets, through an electronic transmission, by means of an internet connection.”
Another federal statute that has been implicated in this type of online gambling is the Wire Act. This statute is designed to protect consumers from illegal gambling by prohibiting the use of the internet to place bets on sporting events, contests, and other events. Likewise, the federal government has taken steps to prevent companies from accepting financial instruments from illegal Internet bets.
